FLORIDA NOTICE OF TAX LIEN FOR EXEMPTIONS AND ASSESSMENT LIMITATIONS

Notice of Tax Lien for Exemptions and Assessment Limitations in Florida

NOTICE OF FLORIDA TAX LIEN: As provided by sections 6321, 6322, and 6323 of the Internal Revenue Code, we are giving notice that taxes (including interest and penalties) have been assessed against the following-named taxpayer. We have made a demand for payment of this liability, but it remains unpaid. Therefore, there is a lien in favor of the United States on all property and rights to property belonging to this taxpayer for the amount of these taxes, and additional penalties, interest, and costs that may accrue. Refinancing to pay off a Florida tax lien can save money on interest and late fees.

Florida Homestead Exemption, Save Our Homes Assessment Limitation, and Portability Transfer

When someone owns property and makes it his or her permanent residence or the permanent residence of his or her dependent, the property owner may be eligible to receive a homestead exemption that would decrease the property’s taxable value by as much as $50,000. This exemption qualifies the home for the Save Our Homes assessment limitation. While the exemption is nontransferable, a homeowner may be able to transfer or “port” all or part of the assessment difference to a new Florida homestead.

  • REFINANCE FLORIDA TAX LIEN– Normally, if you have equity in your property, the tax lien is paid (in part or in whole, depending on the equity) out of the sales proceeds at the closing of your refinance. If the Florida home is being sold for less than the lien amount, the taxpayer can request that the IRS discharge the lien to allow for the completion of the Florida home sale. Taxpayers or lenders also can ask that a federal tax lien be made secondary to the lending institution’s lien to allow for the refinancing or restructuring of a Florida mortgage. The IRS is currently working to speed requests for discharge or mortgage restructuring to assist taxpayers during this economic downturn.

How a Tax lien affects you

  • Credit – Once the IRS files a Notice of Florida Tax Lien, it may limit your ability to get credit.
  • Bankruptcy – If you file for bankruptcy, your tax debt lien could continue after the bankruptcy.
  • Assets –  A lien attaches to all of your assets and future assets acquired during the duration of the lien.
  • Business -The lien attaches to all business property and all rights to business property, including accounts receivable.

Refinance to Avoid a lien

You can avoid a Florida tax lien by simply filing and paying all your taxes in full and on time. If you can’t file or pay on time, don’t ignore the letters or correspondence you get from the IRS. If you can’t pay the full amount you owe, payment options are available to help you settle your tax debt over time.

Lien vs. Levy

A lien is not a levy. A Florida tax lien secures the government’s interest in your property when you don’t pay your tax debt. A levy takes the property to pay the tax debt. If you don’t pay or make arrangements to settle your Florida tax debt, the IRS can levy, seize, and sell any type of real or personal property that you own or have an interest in.
