One of the advantages of PACE is that it is designed for the PACE assessment and its repayment, to be able to stay with the property. Additionally, Florida statute requires that, prior to a purchaser executing a contract for the purchase of a property with a PACE assessment, the seller give the following written disclosure statement to the prospective purchaser:

QUALIFYING IMPROVEMENTS FOR ENERGY EFFICIENCY, RENEWABLE ENERGY, OR WIND RESISTANCE. – The property being purchased is located within the jurisdiction of a local government that has placed an assessment on the property pursuant to s. 163.08, Florida Statutes. The assessment is for a qualifying improvement to the property relating to energy efficiency, renewable energy, or wind resistance, and is not based on the value of the property. You are encouraged to contact the county property appraiser’s office to learn more about this and other assessments that may be provided by law.  

Can I pay off A Florida PACE loan early? 

Yes, you can pay off a Florida PACE assessment early, however, it must be in full. Depending on the PACE provider, there may be a fee and/or minimum payment amount with early payoff. Please contact the PACE provider to determine what, if any, fee or payment they may charge and to discuss early payoff of your project. Additionally, if the payoff occurs after that year’s PACE assessment has already been submitted to the property appraiser, the amount of that year’s PACE assessment will not have been included in the payoff and will still be due with the property taxes.

REFINANCING PACE AGREEMENT AND ADDENDUMThe Green Corridor Property Assessment Clean Energy (PACE) District, a public body corporate and politic duly organized and existing under the laws of the State of Florida whose addressed in Florida 33351 (the “District”), and all of the persons or entities identified below as the record owner(s) (the “Owner”) of the fee title to the real property identified in Exhibit A(the “Property”), entered into an Agreement to Pay Assessments and Finance Qualifying Improvements (the “Agreement”) dated for financingthe Qualifying Improvements on the Property. In the Agreement, the parties agreed that a non-ad valorem special assessment (“Assessment”) shall be collected by the District to repay the cost for funding the improvements. A Summary Memorandum of Agreement, summarizing appropriate terms of the Agreement, was recorded in the public records of Broward County on in OR CFN  Pages 1-4, and the Addendum to the Summary was recorded in the public records of Broward County. The Agreement is hereby terminated effective with the mutual agreement of the parties thereto. Accordingly, by its execution hereof, the District hereby releases, relinquishes, and discharges its interest in said Agreement and Assessment. The financing is not being administered by your local municipal or county government, property appraiser, or tax collector.

The Assessment is for a Qualifying Improvement to the property relating to energy efficiency, renewable energy, or wind resistance. Of as Summary Memorandum of Agreement, dated provides notice that the Green Corridor Property Assessment Clean Energy (PACE) District, a public body corporate and politic duly organized and existing under the laws of the State Florida whose address is 5, (the “District”) and all of the persons or entities identified below the record owner(s) (the “Owner”) of the fee title to the real property identified in Exhibit A (“the “Property”), have entered into an Agreement to Pay Assessments and Finance Qualifying Improvements (the “Agreement”) to finance the Qualifying Improvements listed in Exhibit B on the Property. The parties agreed that the District will collect a non-ad valorem Assessment to repay the costs of funding the Qualifying Improvements. The Assessment to be levied on the Property constitutes a lien on the property, which will be collected along with the annual property taxes. The lien will take first priority over all liens, including mortgage liens, and the property will be used as collateral to secure the amount of the financing. The final principal amount of the Assessment will be outlined in an addendum to the Agreement to be recorded in the public records of the applicable county upon completion of the installation of the Qualifying Improvements.
